Be First

By submitting your application, you hereby certify that the answers/information you provide in said application are true and complete to your knowledge, and you hereby authorize Eddie Bauer and its agents to verify the information contained therein. You agree to cooperate with Eddie Bauer in such a manner to facilitate accurate verification.

Applications may not include any intellectual property of third parties, including copyrighted materials (including but not limited to music) or third party trademarks, and applicant must have permission from any person whose name, likeness or voice is used in any application materials. Applicant warrants that application contains Applicant’s original creative works and/or Applicant has the right to use and right to assign the use of all copyrights in and to the application.

Any applications containing dangerous, obscene, indecent, violent, sexually explicit, discriminatory, or other morally or legally objectionable depictions or material, in the opinion of the sponsor, will result in the rejection of the corresponding application and of the applicant(s) who submitted it.

Submission of an application constitutes the applicant’s irrevocable assignment and transfer to Eddie Bauer any and all rights, title, and interest in and to the application, and any components thereof, including, without limitation, all intellectual property rights. Applicant agrees to execute all assignments or other documents and do all things necessary to enable Eddie Bauer to enforce and perfect such rights, title and interest in and to the application. Submission of an application also grants Eddie Bauer the right in perpetuity to publish, use, adapt, edit and/or modify the application and application materials in any way, in commerce and in any and all media worldwide now known or hereinafter developed, without limitation and without further consent, consideration or notice to the applicant. In addition, Eddie Bauer does not encourage or endorse in any way, potentially high-risk activities that may be proposed as a part of an applicant's sponsorship submission.

Eddie Bauer may, at its sole discretion without notification, modify, suspend or terminate the Be First program at any time and may choose not to fund any applicant(s) and/or applicant team(s) during any of the outlined Be First program periods. You will be responsible for all taxes triggered by your receipt of sponsorship from Eddie Bauer. By application to participate in the Be First program, each applicant forever and irrevocably releases and holds harmless Eddie Bauer, and its parent, subsidiary companies, affiliates, members, employees, officers, directors, and agents from and against all losses, damages, liabilities, claims, actions, proceedings, or judgments arising out of, indirectly or directly caused by, or relating to the application to or participation in the Be First program, or sponsor-related activities, and you shall execute such documentation reflecting such release as requested by Eddie Bauer. Eddie Bauer employees are not eligible for the Be First sponsorship program.
